I am going to steal some of what "greatwhitebuffalo" wrote over at Dkos, which got very little attention, and add some current updates.

This is the story of medical marijuana, the law of unintended consequences and the astonishing obtuseness on the part of physicians who in acquiring godlike authority over life and death seem to have lost touch with their own basic humanity.

In addition to his great talent and a girlfriend who loves him dearly, Timothy Garon also has hepatitis C. Without a new liver, he has days to live. Right now, his death is assured because the transplant committee  at the University of Washington Medical Center has refused to add Tim to the transplant list because he uses medical marijuana to ease his discomfort, medical marijuana which was prescribed by his physician.

   "I'm not angry, I'm not mad, I'm just confused," said Garon, lying in his hospital bed a few minutes after a doctor told him the hospital transplant committee's decision Thursday.

Many transplant committees automatically reject patients who use "illicit substances." The transplant committee  at the University of Washington Medical Center reviewed Garon's application at the request of his lawyer and denied it a second time.

   "Everyone agrees that marijuana is the least habit-forming of all the recreational drugs, including alcohol," Gieringer said. "And unlike a lot of prescription medications, it's nontoxic to the liver."

I think it's time to kick up a fuss and save this man's life, don't you? Personally, I'm not sure where to begin and I want to post this diary as soon as possible. I'll amend it to add your suggestions. Hundreds of thousands of people visit this site every day. Most of them are activists. Let's figure out what to do about this together (please recommend this diary if you think the cause is worthy).

SEATTLE (AP) - A musician who was denied a liver transplant because he used marijuana with medical approval under Washington state law to ease the symptoms of advanced hepatitis C died Thursday.

The death of Timothy Garon, 56, at Bailey-Boushay House, an intensive care nursing center was confirmed to The Associated Press by his lawyer, Douglas Hiatt, and Alisha Mark, a spokeswoman for Virginia Mason Medical Center, which operates Bailey-Boushay.

Dr. Brad Roter, the physician who authorized Garon to smoke pot to alleviate for nausea and abdominal pain and to stimulate his appetite, said he did not know it would be such a hurdle if Garon were to need a transplant.

Garon died a week after his doctor told him a University of Washington Medical Center committee had again denied him a spot on the liver transplant list because of his use of marijuana, although it was authorized under Washington state law.

I would love to see this on the rec'd list.

My g/f was acquainted with Tim Garon. He also was a friend of her and my late friend Rose. Rose suffered terribly due to diabetes. She was followed in death by another close friend of ours, Billie Jean, who died because she had no health insurance and wasn't able to afford her insulin and other diabetic supplies. She was in otherwise good health, but was unable to balance her blood sugar levels one fateful day.

... universal health care and an END to the STUPID "War On Drugs" - please...

I am very sorry to hear about this, but thank you for sharing  his music with us.  I've lived in Washington State for 15 of my 26 years, and I've consistently been blown away by the depth of musical talent in Seattle (and Tacoma too).

I'm with you all the way on getting rid of the stigma associated with medical marijuana.  Anybody who would deny someone something that helps them cope with an illness like this is... well, the scum of the earth.  I'm sure their opinion would change if either they or someone they love was in a similar situation.

It's inhumane to accept BS propaganda which is what the Drug war has always been, in order to deny people's who need to ail their suffering in any way they can and to deny him a life saving treatment because of that is inhumane and I'm very sorry for his loss. He was a talented musician and I do hope this makes the recc list, but it's not a primary wars diary, so I guess that's why.

Our attitude towards a drug that has killed no one to date, is ignorant and inhumane and people who have a prescription for it really need it and they should not be looked at like an animal because of it. When, indeed, will we wake up and realize our collective stupidity?

What struck me reading about (3.00 / 3)
Garon in our papers was not only that his doctor had recommended the marijuana (so the excuse for denying him a transplant was what???), but also that his doctor was savvy enough that marijuana had been the only medication he prescribed and the only medication Garon was using, because marijuana can have disasterous effects with other medications, just as any cross-medication has and I've seen it first hand.  But in this case, it was used with complete responsibility and is probably the ONLY thing that kept Garon alive long enough to qualify for the transplant.  This is beyond outrage.  Thanks for the list of institutions to vent that outrage on.

It can have disastrous effects with cross medications(as any cross medication, but the same goes for alcohol), but the reason he was denied treatment was (I believe)ideological and had nothing to do with his health or that procedure as you have alluded to for it was the only reason he was alive as long as he was able to qualify for the transplant. I don't see any other reason he would be denied rather than the narrow outlook of our society when it comes to ANY marijuana use going back to the Rockefeller propaganda campaign to Nixon then Reagan and the so-called moral majority who apparently is pro-life, but if someone needs medicinal marijuana to live and his doctor states as such, he has to die because of their hatred of hippies and counterculture from way back.

Indeed, this is an outrage and this is a great diary with lot of important information to vent that outrage.

I just read this. Just now. I wish I would have known that this was happening before it was too late. My condolences to the Garon's family and friends.

This is so wrong in so many ways. I can't believe they denied him treatment because he was prescribed marijuana.

I hate to see people like Garon struggle for no good reason. There should be repercussions for the folks at UW medical. Are there grounds for a lawsuit? At the very least a lawsuit could bring even more publicity to their immoral actions so that a similar incident could be prevented in the future.
